Default New NY Bill Involving Domain Names

So I found this rather "interesting" bill that's been blogged by some domainers
I know:

http://assembly.state.ny.us/leg/?bn=S03814&sh=t

Quote:
Relates to cyber piracy protections and the unlawful registration of domain
names; prohibits the registration of a domain name that consists of the name of
another living person, or a name substantially and confusingly similar thereto,
without that person`s consent, with the specific intent to profit from such
name by selling the domain name for financial gain to that person or any third
party; provides for injunctive relief and other civil remedies.

For the full text:

http://assembly.state.ny.us/leg/?bn=S03814&sh=t

A news article indicated it was "approved" by appearingly the same governor
who UDRP'ed his namesakes back then:

http://domains.adrforum.com/domains/...ons/919828.htm

No wonder there was enthusiasm in getting this through.

Nothing really, folks. Just posting something if you're interested in reading
and blasting away, although I imagine someone in New York might complain.

Now if that starts a trend a lot of lawsuits will be prevented.

I assume this only applies to residents in NY who are registering domain names, and not people outside fo the NY?

Yes, I would think from what I have heard about it that it only pertains to NY but I would not be surprised to see other places adopt this also.

I am pretty sure that the fact that it is in NY, will serve as a precedent for lawsuit even if the situation happens in another State. But I am sure people will get away with it no matter what!

This reminds me of illegal MP3 sites operating in other countries to avoid enforcement of some digital rights management laws.

I think that "window of opportunity" is closing, too.

THE MOST absurd thing I ever heard in my life!
Internet is not local.
What's % of NY Population against Entire World?

Even if NY has 50% population of the world, it's not going to work.
Domainers in NY can and will always set up partnership with domainers
outside of NY and continue registering/buying personal names.

They got nothing better to do?

You're right in that even if other states adopted this that there would be some loophole that would be found to get around this law.
