This is an interesting scenario, and although the laws have now changed a bit (and they are changing fast from what I gather), here's an interesting case

It's a bit of a dry read because it's the court's findings, but what I found most interesting was how they decided whether or not the domain name was registered in 'bad faith' ...ie in order to screw the larger company.
